Notice to Adult Victims of Family Violence

It is a crime for any person to cause you any physical injury or harm, EVEN IF THAT PERSON IS A MEMBER OR FORMER MEMBER OF YOUR FAMILY OR HOUSEHOLD.

PLEASE TELL the investigating Police Officer:

  • IF you, your child, or any other household resident has been injured; Or
  • IF you feel you are going to be in danger when the Police Officer leaves or later.

YOU HAVE the right to:

ASK the local prosecutor to file a criminal complaint against the person committing family violence and APPLY to a court for an order to protect you (you should consult a legal aid office, a prosecuting attorney, or a private attorney). For example the court can enter an order that:

  1. Prohibits the abuser from committing further acts of violence;
  2. Prohibits the abuser from threatening, harassing or contacting you at home;
  3. directs the abuser to leave your household; and
  4. established temporary custody of the children and directs the abuser not to interfere with the children or property.

A VIOLATION of certain provisions of court-ordered protection (such as 1. And 2. Above) is a criminal offense.

Aviso a Víctimas de Violencia Intrafamiliar

Es un CRIMEN que cualquier persona le cause daño físico o le lastime, AUN CUANDO ESA PERSONA SEA UN MIEMBRO O EXMIEMBRO DE SU FAMILIA O CASA.

POR FAVOR dígale al oficial de policía investigando:

  • Si usted, o su niño, o cualquier otro residente de su casa ha sido lastimado, o
  • Si usted piensa que estará en peligro cuando el oficial de policía deje el lugar o después.

USTED TIENE EL DERECHO DE:

PEDIRLE al procurador local que asiente una demanda criminal contrala persona que cometa o este cometiendo la violencia intrafamiliar y ACUDIR a la corte por una orden que le proteja a usted (Usted debe consultar con una oficina de asistencia legal, o con un abogado privado). Por ejemplo, la corte puede sentar una orden en la cual:

  1. Prohíbe al abusador o mal tratador, o el violador, continuar cometiendo actor de violencia.
  2. Prohíbe al abusador que le amenace, le acose, o se cominuqie con usted en su hogar.
  3. Prescribe al abusador para que deje de inmediato su hogar.
  4. Establece custodia temporal de sus hijos y prescribe al abusador de no interferir con los niños o la propiedad.

UNA VIOLACION DE ESTAS PROHIBICIONES DE PROTECCION ORDENADA POR LA CORTE (Como la 1ª y la 2ª anteriormente mencionadas) ES UNA OFENSA CRIMINAL.
